(1.) Heard learned counsel for the appellant. Perused the record.

(2.) Learned counsel for the appellant would rely on an order passed in similar matter by the Coordinate Bench of this Court namely; First Appeal No.2566 of 2023 dtd. 23/6/2023. He further requested this Court to pass a similar order in this matter too as the interest of justice would meet. The order dtd. 23/6/2023 reads as under:
