PARESH HAMIRBHAI NIZAMA Vs. STATE OF GUJARAT

JUDGEMENT

(1.) This application has been preferred under sec. 438 of the Code of Criminal Procedure seeking anticipatory bail in connection with the complaint being FIR No.11199028220726 registered with Jhagadiya Police Station, District : Bharuch for the offences punishable under Sec. 406, 415, 420 and 114 of IPC.

(2.) Learned advocate for the applicants submitted that the applicants are not owners of the land in question; instead, they are employees of the developers. The co-accused have already been enlarged on bail. It was, therefore, prayed that discretion may be granted in favour of the applicants.

(3.) Learned APP appearing on behalf of the respondent - State opposed the grant of anticipatory bail to the applicants in view of the nature and gravity of offence. It was, accordingly, urged that no discretion may be exercised in favour of the applicants.
