JUDGEMENT

(1.) Though matter is listed for admission, by consent of learned advocates appearing for the parties, it is taken up for final disposal.

(2.) We have heard Mr. Rakesh Patel, learned counsel appearing for the petitioners, Mr. Sahil Trivedi, learned Assistant Government Pleader appearing for respondents 1 and 2 and Mr. K.M. Antani, accepts notice and waives notice for respondent 3.

(3.) The short point that arises for consideration is :
