JUDGEMENT

(1.) Heard Ms. Namrata Chauhan, the learned advocate appearing for the petitioner and Mr. Shivam Dixit, the learned AGP appearing for the respondent Nos. 1 to 4.

Briefly stating, the petitioner herein is the lawful owner and occupier of government land bearing Survey No. 191/1 paiki 51 admeasuring 0/80/94 Hector, for building limestone, situated at Village: Divasa, Ta: Mangrol, Dist: Junagadh (hereinafter referred to as the subject land) for which the petitioner has obtained LOI from the concerned authority on 7/5/2021 qua the application dtd. 18/6/2016.

(3.) The petitioner had made an application for approval of mining plan before the respondent No.4 and the same was approved by the authority dtd. 26/5/2021. The petitioner herein has NA approval which came to be approved by the District Development Officer on 31/7/2017. The petitioner has also made an application for obtaining environment clearance certificate to District Level Environment Impact Assessment Authority (for short DEIAA), which has been accepted by DEIAA dtd. 6/12/2018. The petitioner herein has applied for carrying out measurement of the subject land and fixing the boundaries and polls on the subject land and also paid required fees towards the concerned authority. The same has been done by the respondent authority and final measurement sheet is issued to the petitioner.
