JUDGEMENT

(1.) Heard Mr.Kamal Trivedi learned Senior Advocate with Mr.Premal Joshi learned advocate for the petitioner and Mr.Mihir Thakor learned Senior Advocate with Mr.Shaan Munshaw learned advocate with other learned advocates as mentioned in the cause title of this order for respondent nos.1 and 2.

(2.) Challenge in this petition is to the communication dtd. 19/1/2023, by which, the respondent has sought to invoke LC bearing No.2031ILCIS0000812 (Rs.132.76 crore) 2031ILCIS0000412 (Rs.51.04 crore), 2031ILCIS0000612 (Rs.21.50).

(3.) It is undisputed between the parties that the matter with regard to communication dtd. 19/1/2023 is a subject matter of challenge before the APTEL. This communication prima- facie is pursuant to the orders issued by the CERC dtd. 3/1/2023 in petition No.128/MP/2022.
