JUDGEMENT

(1.) By way of the present arbitration petition, the petitioner has prayed to appoint an arbitrator to resolve the disputes between the parties.

(2.) Though served none appears for the respondents.

(3.) Mr. Paras Sukhwani, learned advocate appearing for Mr. Chirag Sukhwani, learned advocate for the petitioner would rely on an order passed by this court on 1/4/2022 in Arbitration Petition No. 13 of 2020 in connection with the same parties whereby this court has appointed Justice S.R. Brahmbhatt (retired), Former Judge of this Court as arbitrator. Since the subject matter of Arbitration Petition No. 13 of 2020 is ongoing, learned advocate for the petitioner would submit that Justice S.R. Brahmbhatt (retired), Former Judge of this Court may be appointed as arbitrator in the present proceedings also.
