JUDGEMENT

(1.) THIS appeal has been filed by the appellants-original opponent Nos.1 to 3 being aggrieved and dissatisfied with the judgment and award dated 27-

(2.) -2009 passed by the learned Commissioner for Workmen's Compensation and Labour Court No.2, Ahmedabad in Workmen Compensation Application No.61 of 2002 awarding compensation of Rs.2,18,470/- to the claimants with interest @ 12% per annum from the date of accident. 2. Facts in short are that the deceased Rameshbhai Samantbhai Rathod was serving with the opponent No.1 and on the date of incident i.e. on 28-2-1999 when the deceased was doing plastering work on the sixth floor, RCC ceiling of terrace fell on Rameshbhai causing his death. The legal heirs of the deceased therefore filed Workmen Compensation Application No.12 of 1999 before the Workmen's Compensation Commissioner claiming compensation.

(3.) I have heard learned advocate, Mr.Dipak Dave for the appellants and have also taken into consideration oral as well as documentary evidence.
