JUDGEMENT

(1.) THIS petition was filed by the petitioner praying that the respondents be restrained from giving appointment to respondent no.3, the person who was selected for appointment. On 14.03.2005, at the time of issuance of notice this Court directed the respondents to maintain status quo with respect to appointment to the post in question. That interim relief was modified by order dated 05.07.2005 to the effect that,

(2.) LEARNED advocate Mr.Bipin P. Jasani for respondent no.2 - school states that no appointment was given to respondent no.3. Besides that learned advocate Mr.Jasani states that Recruitment Rules are also changed, therefore this petition becomes infructuous.

(3.) IN view of the above this petition is disposed of as infructuous. Rule is discharged. Interim relief is vacated. Liberty is reserved in favour of the petitioner to apply in case of difficulty.
