JUDGEMENT

(1.) WE have heard learned AGP Ms. Monali Bhatt, for the appellant.

(2.) THIS Letters Patent Appeal has been filed by the appellant, challenging the judgment dated 10th September, 2003 passed by the learned Single Judge in Special Civil Application No. 1179 of 1999.

(3.) THIS order of the Learned Single Judge was modified by the Division Bench while granting relief on 3rd December, 2004 in Civil Application No. 7859 of 2004. The order dated 3rd December 2004 reads as under :
