JUDGEMENT

(1.) Since both these appeals arise out of the same judgment and order of conviction and sentence passed by the learned trial Court, these appeals are being decided together by this common judgment.

(2.) Criminal Appeal No. 583 of 2011 has been filed by the appellants original accused Nos. 3 and 4 against the judgment and order of conviction and sentence dated 10.03.2011 passed by learned Additional Sessions Judge, Porbandar, in sessions Case No.9 of 2008, whereby the learned Trial Court has convicted the present appellants for the offence under sections 302 of the Indian Penal Code (for short "IPC") and 135 of the Bombay Police Act.

(3.) Criminal Appeal No. 688 of 2011 has been filed by appellant State against the same judgment and order, whereby the trial Court has acquitted the original accused No.5 of all the charges levelled against him.
