(1.) THE petitioners, who were employees of Chhaya Gram Panchaya, now converted into Chhaya Municipality- respondent No.2, seek mandamus directing the respondent authorities to give pension as well as other retiral benefits with interest at the rate of 18% per annum.

PENDING the petition, the petitioners had moved Civil Appication No.4435 of 2013 seeking amendment to place on record Government Resolution dated 1.12.2009, under which it was decided to give pension benefits to the allocated employees of the Panchayat on its conversion into Municipality and also to place on record the pension sanctioned orders in respect of the similarly situated employees of the very converted Municipality.

TODAY , when the matter is taken up for hearing, learned Assistant Government Pleader Mr. Maheta stated before the Court that the case of the petitioners are covered under the above-said circular and they are similarly situated to the employees who have been given pension benefits under the said circular. He further states that on the respondent No.2 Municipality submitting pension papers to the Local Fund Accounts Office, Junagadh, the petitioners are also to be given similar treatment by sanctioning pension in their favour.
