JUDGEMENT

(1.) THE present appeal is directed against the order dated 4.7.2012 passed by the learned Single Judge of this Court in Special Civil Application No.7361 of 2012, whereby the learned Single Judge has dismissed the petition on the ground that the execution proceedings are available.

(2.) PENDING the present Letters Patent Appeal, after the order was passed by this Court for issuance of notice, this Court on 21.2.2013 had passed the following order:-
