(1.) WE have heard Mr. Utkarsh R. Sharma, learned counsel appearing for the petitioner and Mr. Shakeel A. Qureshi, learned counsel appearing for the respondents.
(2.) AN affidavit-in-reply has been filed by the respondents.

LEARNED counsel for the petitioner has urged that under the new Rules, Head Constable (Cipher), Head Constable (Radio Operator) and Constable (General Duty) are to be absorbed on 35% posts of Assistant Sub Inspector (Cipher) through Limited Departmental Competitive Examination. However, the posts of Head Constable (Radio Operator) and Constable (General Duty) are non-technical posts and Cipher is a technical trade and cryptography (breaking the codes) requires specialisation and expertise along with proper experience. Hence, Head Constable (Radio Operator) and Constable (General Duty) cannot be promoted as Assistant Sub Inspector (Cipher) as they do not carry any experience as far as cryptography (breaking the codes) is concerned.
