(1.) THE petitioners, who happened to be the candidates in the combined competitive examination for the post of Deputy Section Officer (State Secretariat, Gujarat Legislative Assembly, Secretariat, Gujarat Public Service Commission) and Deputy Mamlatdar (Revenue Department) Class III, conducted, pursuant to Advertisement No.20/2011 12 on 24/09/2011 and 25/09/2011, by the Gujarat Public Service Commission, have approached this court by way of this petition filed under Article 226 of the Constitution of India with the following prayers.
(2.) THE facts leading to filing of this petition deserve to be set out as under in order to appreciate the controversy in question.
(3.) THE Gujarat Public Service Commission (GPSE hereafter) released an advertisement No.20/2011 12 dated 24/09/2011 for 948 vacancies in the posts of Deputy Section Officer (State Secretariat, Gujarat Legislative Assembly Secretariat, Gujarat Public Service Commission) and Deputy Mamlatdar (Revenue Department) Class III. The 948 vacancies were to be filled by the candidates of general category and reserved category as mentioned in paragraph no.3.2 on page no.4, and on page no.74 i.e. copy of the advertisement, which could be reproduced herein below for ready reference.
