(1.) Heard Mr.R.M.Chauhan learned advocate for the petitioner and Mr.P.Y.Divyeshvar learned advocate for the respondents.

The challenge in this petition under Article 226 of the Constitution of India is to the non-appointment/selection of the petitioner for the post of Constable (Tradesman) Sweeper for General Category. The prayer in the petition is that one Pankaj Yadav Jagdevprasad found his name in the merit list and was appointed though his role number was not reflected in the result of the written test nor in the list of the candidates for the medical test.

Mr.R.M.Chauhan learned advocate for the petitioner would take the Court through several documents suggesting that the petitioner had successfully undergone his physical efficiency test, the written examination and the medical test and his name figured in the merit list of the written examinations in the unreserved category of CT (sweeper). The cutoff marks for CT (sweeper) was 36 whereas, the petitioner has secured 48 marks which were much above the cut-off. Assailing the final result of the selection, he would submit that the name of Pankaj Yadav Jagdevprasad though not being found in any of the merit list either the written or medical examination and there is no explanation tendered as to how his name suddenly cropped up in the merit list.
