AHMEDABAD GYMKHANA CLUB Vs. UNION OF INDIA

JUDGEMENT

(1.) Ahmedabad Gymkhana Club situated on land bearing number 109 admeasuring 1.77 acres in the Cantonment of Ahmedabad has filed this petition challenging the order dtd. 25/6/2021 by which pursuant to a show cause notice dtd. 9/1/2017, the Defense Estate Officer, Gujarat Circle, Ahmedabad, determined the lease given to the Club. Also under challenge by way of subsequent amendments is the Eviction Notice dtd. 4/8/2021 and an order dtd. 20/5/2022, by which, the application for grant of renewal and extension of lease has been rejected.

(2.) By way of a separate Civil Application, the petitioner - Club has prayed for suspension of the eviction notice dtd. 18/10/2022 directing the petitioner club to show cause on or before 25/10/2022 as to why an eviction order should not be made.

(3.) Facts in brief would indicate that it is the case of the petitioner that the Ahmedabad Gymkhana Club was established in the year 1885 as one of the Ahmedabad's oldest recreational club. It is the case of the petitioner that high ranking Army Officers are in the management of the Club. These positions are held by them by virtue of the bye -laws in force.
