JUDGEMENT

(1.) Learned advocate for the petitioner seeks permission to withdraw this petition, in view of the communication dtd. 3/10/2022 received from the Sarpanch, Sarigram Gram Panchayat and addressed to the learned advocate for the petitioner, with a view to file appropriate appeal before the District Development Officer, with a further request to extend the interim relief for 30 days. Permission as prayed for is granted. This petition stands disposed off as withdrawn. Notice is discharged.

(2.) The petitioner shall file the appeal before the District Development Officer within a period of two weeks from the receipt of this order and the District Development Officer shall decide the same on merits after considering the rival submissions, without being influenced by withdrawal of this petition and in accordance with law, as expeditiously as possible. The interim relief granted in this petition which is continuing till today is further extended till the present petitioner files appeal before the District Development Officer. It is clarified that the petitioner shall not claim any equity pursuant to this order.
