JUDGEMENT

(1.) This application has been filed under sec. 439 of the Code of Criminal Procedure for regular bail in connection with the FIR No.11824004220224 of 2022 registered with Songadh Police Station, Tapi for offences punishable under Sec. 65(e) , 81 , 83 and 98(2) of the Prohibition Act .

(2.) Learned advocate for the applicant submitted that, the liquor to the tune of Rs.85,200.00 was found from the vehicle. It was, therefore, prayed that the present application may be allowed and the applicant herein may be released on regular bail.

(3.) Mr. J.K. Shah, learned Additional Public Prosecutor submitted that, the applicant was found in the alleged offence and therefore, prayed that no discretion may be exercised in favour of the applicant.
