(1.) The present application has been filed for the following reliefs:

It is the case of the first informant that on 19/2/2022, when he was patrolling, he received secret information that one Eicher Truck having registration No.GJ-15-AV-1224 is moving with illegal liquor and, therefore, as per the information, they arranged panchas and set up a watch and at that time, one Eicher Truck was coming to them and they stopped the vehicle for search and they found liquor worth of Rs.36,700.00 from the vehicle and also arrested one accused. Upon inquiry, the accused stated that he had purchased the liquor from the present applicant. Upon such statement, the Police has registered the impugned F.I.R. against the accused.

Learned senior advocate Mr.I.H.Syed on behalf of the applicant has submitted that the applicant has not committed any crime and he has been falsely implicated in the offence on the statement of co-accused. He has submitted that it is tendency of local Police to implicate the petitioner in false offence and in past also, the petitioner was booked into the offence, where he has not played any role and the applicant is facing such false implications since very long. It is submitted that there are many FIRs, which are falsely registered against the applicant and in none of the FIRs, the applicant came to be arrested on the spot. It is submitted that the applicant came to be implicated in number of offences by way of transfer warrant and recently, he has been enlarged on regular bail by this Court vide order dtd. 29/11/2021 passed in Criminal Misc. Application No.18519 of 2012 in one of the FIRs registered against him. It is submitted that in the said order, the applicant is directed not to leave Mumbai for a period of six months, without prior permission of the trial Court and applicant has followed the condition imposed by this Court and started living in Mumbai in rented premises on the agreement of live and license. It is submitted that the applicant used to mark his presence as per the order before the Malaad Police Station, Mumbai regularly.
