JUDGEMENT

(1.) THE present appeal, under section 378 of the Code of Criminal Procedure, 1973, is directed against the judgment and order of acquittal dated 30.07.2011 passed by the learned Metropolitan Magistrate, Court No.6, Ahmedabad in Criminal Case No.1172/2007, whereby the accused have been acquitted of the charges under section 7(1) and 16(1)(A) of the Prevention of Food Adulteration Act, leveled against the respondent � accused.

(3.) LEARNED advocate Mr.D. K. Modi for the respondent No.1 has submitted that the learned Magistrate has not committed any error in acquitting the accused from the charges levelled against him. He has, therefore, prayed that the judgment and order of the learned Magistrate deserves to be confirmed and the criminal case requires to be dismissed.
