JUDGEMENT

(1.) BY way of this appeal, the appellant has challenged the judgment and award passed by the Motor Accident Claims Tribunal, Ahmedabad in Motor Accident Claims Petition No.240 of 1987, whereby the Tribunal has awarded Rs.43,700/- to original claimant with running interest at the rate of 12% p.a. from the date of the application till its realization.

(2.) THE facts of the case is that on 06.06.1987, the appellant was going on the scooter as pillion rider one Kamal Bhagat was driving the said scooter on correct side of the road at moderate speed. At that time, one AMTS bus driven by original opponent No.1 came in full speed, without blowing horn or giving signal and dashed with the scooter. As a result, the appellant sustained grievous injuries. THErefore, the appellant filed claim petition being Motor Accident Claims Petition No.240 of 1987 before the Motor Accident Claims Tribunal, Ahmedabad for compensation.

(3.) LEARNED counsel Mr.Munshaw for the respondent has supported the judgment and award passed by the Tribunal and submitted that no interference is called for and the appeal deserves to be dismissed.
