(1.) Rule. Learned APP waives service of rule on behalf of the respondent - State. Heard learned advocate appearing for the respective applicants and learned APP for the respondent-State through V.C.

These applications are filed under Section 439 of the Code of Criminal Procedure for regular bail in connection with F.I.R. registered at C.R.No.11208055210145 of 2021 with DCB Police Station, Rajkot for the offences punishable under Sections 381, 408, 420 and 114 of IPC, under sections 3, 7 and 11 of Essential Commodities Act, and under section 53 of the Disaster Management Act.

Learned APP strongly objects for grant of bail on the ground that during pandemic period, the applicant-Mr.Mehul was found involved in black marketing of 2 Injections, applicant-Mr.Ashok was found involved in black marketing of 5 injections and applicant-Mr.Sagar was found involved in black marketing of 12 injections of Amphotericin B and thus, deprived to needy patient out of its reach.
