JUDGEMENT

(1.) While hearing the matter on 05.07.2021, the learned advocate for the applicant has specifically mentioned that no warrant under section 70 or 82 of the Code of Criminal Procedure, 1973 (for short "the Code") has been issued against the applicant.

(2.) By way of the present application filed under Section 438 of the Code, the applicant-accused has prayed for bail in connection with the FIR being C.R. No.I-245 of 2018 registered with Sardarnagar Police Station, Dist.Ahmedabad for the offences punishable under Sections 406, 420 and 120B of the Indian Penal Code, 1860.

(3.) The case of the prosecution in brief is that the applicant, along with co-accused have siphoned away the money of the first infromant to the tune of Rs.9,77,600/- by not supplying the goods and closing their shops.
