JUDGEMENT

(1.) LEARNED counsel for the parties have stated that instead of deciding the Civil Application, main Letters Patent Appeal itself may be decided. On the joint request of the learned counsel for the parties, we have taken up Letters Patent Appeal itself for final disposal.

(2.) WE have heard Mr.Kamal Sojitra, learned counsel appearing for the appellant and Mr.A.R.Thacker, learned counsel appearing for the respondent.
