(2.) WE have heard Mr. B. R. Acharya, learned Counsel appearing for the appellant, Mr. N. J. Shah, learned Assistant Government Pleader appearing for respondent Nos.1 & 2 and Mr. H.S. Munshaw, learned advocate appearing for respondent No.3.
