(1.) THE petition appears to have been filed by the petitioners under Article 227 of the Constitution of India as for filing a writ petition under Article 226 of the Constitution, Labour Court has not been added as party -respondent. Learned counsel for the appellants has urged that in the cause title of the petition, Article 226 of the Constitution has been mentioned.

HEARD Ms.Vinita Vinayak, learned counsel appearing for Thakkar Associates appearing for the appellants and Mr.M.T.Mishra holding brief of learned counsel Mr.T.R.Mishra appearing for the respondents. Similar matters arising between the same parties Botad BNagarpalika and other employees, all the writ petitions were dismissed by the learned Single Judge which was subject matter of SLP before the Apex Court and the Apex Court in its order dated 30.4.2009 in SLP(Civil) No.26377 of 2005 has observed as under:
(3.) SINCE similar matters have been dismissed by the Apex Court on 30.4.2009, this Letters Patent Appeal is also dismissed on the same ground.
