(1.) THIS Letters Patent Appeal has been filed challenging the judgment and order dated 09.11.2006 passed by the learned Single Judge in Special Civil Applications No.7280/1996.

(2.) WE have heard learned counsel Mr. YF Mehta for the appellant and Mr. Supehia learned counsel for the respondent. While deciding the writ petition filed by the respondent, the learned Single Judge observed in Para - 6 of the order as under;
