JUDGEMENT

(1.) Following reliefs have been prayed in this petition: "

(2.) The petitioner is a retired government servant who was discharging his duties as Section Officer in Food, Civil Supplies and Consumer Affairs, Sardar Bhavan, Gandhinagar. A piece of land came to be alloted to the petitioner vide sanad dated 06.08.1991 by respondent no.2 at concessional rate under government policy whereupon the construction has been put and other necessary formalities were also completed. The petitioner now intends to sale the property and permission for the same having been declined by the respondent; this petition is filed.

It appears that Special Leave to Appeal (Civil) No. 896 of 2012 and Special Civil Application No. 13550 of 2000 concerns the issue of allotment of the plots to the government servants at concessional rate and are now pending with the Supreme Court. Special Civil Application No. (Suo Motu) No. 13550 of 2000 was called for unto itself by the Supreme Court and was ordered to be heard with Special Leave Appeal aforementioned vide order dated 28.08.2017 which reads thus:
