JUDGEMENT

(1.) Learned Assistant Government Pleader waives service of rule on behalf of the respondent-state.

(2.) This petition under Article-226 of the Constitution of India is filed seeking direction to the respondent No.2 - District Development Officer, District- Kachchh to inform the petitioner about the amount of tax to be paid for declaring or converting his land from agricultural to non-agricultural land and also to direct the District Development Officer- Kachchh to issue NA permission to the petitioner.

Learned Advocate for the petitioner submitted that the petitioner had applied for converting his land into non- agricultural land in appropriate format, which the respondent-authorities ought to have decided within stipulated time as provided under the provision of Bombay Land Revenue Code within period of 90 days. However, no decision was taken on such application and according to the petitioner, application was filed on 20-08-2014. However, even after the expiry of 90 days period, no decision was communicated and therefore, again reminder was sent on 02-12-2014 and 19-01-2015 for the same.
