JUDGEMENT

(1.) Rule. Mr.J.K.Shah, learned APP waives service of rule for the respondent - State of Gujarat. With consent of the learned advocates for the parties, the matter has taken up for final disposal today.

(2.) In this petition under Article 226 of the Constitution of India, the petitioner has prayed for appropriate writ, direction and / or order for release of said vehicle - Bajaj Auto Ltd's "Re CNG 45 Rickshaw" bearing registration No. GJ-06-BU-0245, seized as muddamal in respect of FIR being Prohibition C.R.No.III-/118/2019 registered with Devgadh Bariya Town Police Station, District - Dahod under section 65(E) , 98(2) and 81 of Prohibition Act.

(3.) Heard the learned advocate for the petitioner and Mr.J.K. Shah, , learned APP for the respondent-State.
