JUDGEMENT

(1.) This application seeks condonation of delay of 328 days which has occurred in filing First Appeal (Stamp) No.5820 of 2009.

(2.) Heard learned AGP appearing for the applicant. Reasons stated in the application have been reiterated by learned AGP. In absence of any contest, the delay is condoned and the application is allowed accordingly.

(3.) Rule made absolute. There shall be no order as to costs.
