JUDGEMENT

(1.) Second Appeal No.320/1981 is filed by the appellants/original defendants no.1 2 and 3, challenging the judgment and decree passed by the Assistant judge, Nadiad, in Civil Appeal No.67/1978 reversing the judgment and decree passed by learned Civil Judge, (Junior Division), Cambay in Regular Civil Suit No. 101/1972, dismissing the suit of the original plaintiff. This Second Appeal was admitted by this Court and following substantial questions of law were formulated.

(2.) This Second Appeal was admitted by the Court and the same substantial questions of law were formulated as in Second Appeal No. 320/1981.

(3.) Since both these Second Appeals are arising out of the same judgment and decree of Courts below, the same were heard together and are being disposed of by this common judgment and order.
