JUDGEMENT

(1.) RULE. Shri Neeraj Soni, learned AGP waives service of notice of rule on behalf of the opponents.

(2.) With the consent of the learned advocates appearing on behalf of the respective parties the present application is taken up for final hearing today.

(3.) The present application has been preferred by the applicant-original petitioner to restore Special Civil Application No. 11853/2009, which came to be dismissed for non-prosecution vide order dated 12/01/2010 as on that day despite the matter was called out twice, the learned advocate appearing on behalf of the applicant-original petitioner remained absent.
