JUDGEMENT

(1.) THE case was listed for hearing difference of opinion between two Honble Members. Now the applicant filed ROM application for recall/modification of the reference in view of two decisions of Honble Gujarat High Court at Ahmedabad in the case of Colourtex reported in 2006 (199) E.L.T. 200 (Guj.) = 2008 (9) S.T.R. 440 (Guj.) and 2006 (198) E.L.T. 169 (Guj.) = 2008 (9) S.T.R. 426 (Guj.). As the applicant fled this ROM application with the request for recall/modification of the order regarding difference of opinion, therefore, the ROM application be placed before the same Bench which passed the earlier Misc. order regarding which the application is filed.
