JUDGEMENT

(1.) LEARNED Counsel Shri Piyush Kumar appearing on behalf of his clients submits that since the cause list was issued yesterday evening and he saw the same today morning on the notice board he is not prepared for the cases which are listed suddenly without notice.

(2.) On the earlier occasion when the matter was heard the respondents and the counsels were under the impression that the matter shall come from 14th July, onward but that was not done. Since all the matters shall be disposed within 6 months of passing of the order by the Hon'ble High Court of Delhi there should not be disruption of this Bench for consecutive hearing so that order can be passed timely. He requests that the matter being of serious concern to the employee respondents in this batch of appeals he needs instructions from his clients for his arguments and they being outside Delhi this insufficient notice of few hrs issuing cause list shall defeat the purpose of justice. Therefore, minimum 15 days' notice is required for hearing of the matter so that all concerned shall be informed for proper participation of hearing. He agrees that he shall take notice for his clients today but also requests that notice should go to his clients by post. He suggests that the hearing should begin from 1st week of September, 2011 and without break, clear one week may be allotted for completion of hearing.

(3.) SHRI B.L. Narasimhan, learned Advocate appearing on behalf of his client also submits that he needs sufficient notice for proceeding for hearing. He agrees that he shall take notice on behalf of his clients today and also requests that notice should go by post for information of his clients.
