JUDGEMENT

(1.) THE central excise appeal No. E/2636/98, Mumbai filed by M/s. Shaifali Agro Steel Pvt. Ltd., the appellants was disposed of vide final order No. CB/A/828/WZB/2005 dated 25.05.05. Appellants filed a ROM application on 17.10.05 which was assigned No. E./MA(ROM)/2799/05 Mumbai. However the same was not listed and came to be listed before this Bench on 19.04.10 for the first time. Even though the ROM was listed on 24.05.10 and 05.07.10 no one appeared on behalf of the appellants. Accordingly the ROM is taken up for disposal.
