NEETU Vs. STATE OF UTTARAKHAND & OTHERS

JUDGEMENT

(1.) Counter affidavit filed today in the Court by the State is taken on record.

(2.) Heard Mr. Vinod Tiwari, learned counsel for the petitioner, Mr. N.P. Sah, learned Standing Counsel for the State and perused the records.

(3.) The present petitioner has been selected as an Assistant Teacher in Government Primary School, Nainital. The petitioner applied for the said post as an Other Backward Class (in short 'OBC') candidate, as her caste is Gadaria, which is notified as an OBC caste in Uttarakhand as well as in Uttar Pradesh. Admittedly the petitioner prior to her marriage was a permanent resident of Uttar Pradesh, however, she was married to one Dharmendra Kumar Pal, who is a permanent resident of Uttarakhand, which was before the creation of Uttarakhand State.
