(1.) By means of present writ petition, the petitioner seeks a direction to the Principal Judge, Family Court, Dehradun to decide Original Suit no. 42 of 2015, titled as Deepak Dudeja vs Smt. Reshu Dudeja, pending in said court, as provided under Section 21B(2) of the Hindu Marriage Act, 1955, at an early date.
(2.) The innocuous prayer made by learned counsel for the petitioner is allowed. An endeavour shall be made by the court below to decide the aforesaid case, as expeditiously as possible, in the light of provisions contained in Section 21B of the Hindu Marriage Act, 1955, which reads as under:
(3.) It is not necessary for the Court to issue notice to the respondent before giving the aforesaid direction, inasmuch as, it does not lie in one's mouth to say that the decision of any judicial proceeding pending before any Court should be delayed.
