JUDGEMENT

(1.) THE petitioners, in both the writ petitions, were the candidates for the post of State Supervisor in Cooperative Department. The selection was conducted by a Government body known as Uttarakhand Board of Technical Education (from hereinafter referred to as

(2.) THE total number of posts, on which the selections were to be made, are 146. The petitioners appeared in the written examination in which Yashpal Singh Bisht scored 77.25 marks and Saroj Arya scored 69.75 marks respectively. They were selected, however, they were not amongst the first top 146 candidates, who were called for verification of the documents, however, out of these 146 candidates only 117 candidates were came forward for verification of documents and were recommended by the Technical Board to the State Government. In continuation of the same selection process, thereafter 29 candidates were asked for the remaining posts to come forward with the credentials and verification of their documents, out of which only five candidates were found satisfied and the Technical Board recommended their names on 19.10.2013. The names of both the petitioners are figured in the said recommendation. However, the appointment has not been given to them. Hence, they preferred present writ petitions before this Court.

AS far as Technical Board is concerned it has filed its counter affidavit today in the Court stating therein that the petitioners were called for document verification for the remaining 29 vacant posts, and after verification of the documents, their names were recommended to the State Government for appointment. Therefore, as far as the contention of the selection body is concerned, it is supporting the case of the petitioners. However, the objection of the State Government is that there was no provision of waiting list in the said examination, as it was the examination not for one Department but for various departments.
