JUDGEMENT

(1.) Applicant Vijay Viswas is in judicial custody in FIR No.203 of 2022, under Sec. 8/20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 ('the Act'), Police Station Banbhoolpura, District Nainital. He has sought his release on bail.

(2.) This is the second bail application. The first bail application, being BA1 No.2091 of 2022, was dismissed in non-prosecution on 17/11/2022.

(3.) Heard learned counsel for the parties and perused the record.
