TAJJAMUL Vs. STATE OF UTTARAKHAND

JUDGEMENT

(1.) Applicant Tajjamul is in judicial custody in FIR No.113 of 2023, under Ss. 376(3), 506 IPC and Sec. 5(j)(ii), 6 of the Protection of Children from Sexual offences Act, 2012, Police Station Banbhoolpura, District Nainital. He has sought his release on bail.

(2.) Heard learned counsel for the parties and perused the record.

(3.) According to the FIR, on 2/5/2023, the victim had a stomach ache. His brother enquired about it and took her to hospital. It was revealed that the victim is pregnant for 8 months. She revealed that it is the applicant, who had established physical relations with her and threatened her to life, in case she reveals it to anyone.
