JUDGEMENT

(1.) APPELLANT Jasvinder Singh @ Sukhvinder Singh S/o Laxman Singh was tried along with other family members for the offences under Section 498 -A and 304 -B IPC as well as under Section 3/4 of Dowry Prohibition Act in Sessions Trial No. 213/2000. The appellant was found guilty for all the aforementioned offences, while rest of the accused persons were set free. He has appropriately been sentenced by the learned Trial Judge. The trial pertains to the Crime No. 554/2000, Police Station Kashipur, District Udham Singh Nagar.

(2.) DECEASED Manjeet Kaur, a young lady of 21 years, lost her life within 15 months of her wedding in her matrimonial house. She was married to the appellant on 07.02.1999. She died in the intervening night of 9/10 -05 -2000. Inquest Report Ex.Ka -10 was prepared on 10.05.2000 at 10.35 A.M. and it was ended by 13.30 P.M. in presence of Sub -Divisional Magistrate of the area. Her dead body was found lying on a plank inside the room and it was told that she had hanged herself to a hook of the ceiling. The information of her death was conveyed telephonically to the father of the deceased by Sukhdev Singh (another brother -in -law of the deceased), who was a resident of nearby village. So, the father of the deceased Mr. Sheo Singh rushed to the matrimonial house of his daughter and lodged the FIR on 11.05.2000.

(3.) AUTOPSY was conducted on 10.05.2000 at 4:30 P.M. wherein Dr. Shamim Ahmad (PW3) reported the cause of death of asphyxia as a result of hanging. He found antemortem injuries on the body of the deceased as under: - - A ligature mark high up all around the neck 30 cm x 2 cm with a gap of 4 cm x 2 cm on the left side neck below and behind the left ear ligature mark is situated 5 cm below the right ear 4 cm below the chin and 2.5 cm below the left ear on dissection the subcutaneous tissue under the ligature mark is glistening white and hard.
