JUDGEMENT

(1.) MR . Davesh Bishnoi, Advocate, present for the appellant/defendant.

(2.) MR . Bhuvan Bhatt, Advocate, present for the respondents/plaintiffs.

(3.) AN original suit no. 115 of 1986 filed by plaintiffs/respondents was decreed by the trial court on 26.03.1999 in favour of plaintiffs/respondents, against which a civil appeal no.27 of 1999 was preferred by the appellant/defendant Nagar Palika, Kashipur, District Udham Singh Nagar, which was also dismissed on 28.09.1999. After that a second appal was filed by the defendant/appellant before this Court which too was dismissed on 04.12.2006, upholding the decree granted by the Trial Court against the present appellant.
