(1.) Present Criminal Revision has been filed by the revisionist for setting aside the judgment and order dated 20.01.2014, passed by learned Sessions Judge, Udham Singh Nagar, dismissing the Criminal Appeal No. 294 of 2013, Raju vs. State, of the revisionist, confirming the order dated 17.12.2013 in respect of the revisionist by leaned Principal Magistrate, Juvenile Justice Board, Rudrapur, District Udham Singh Nagar by which bail of the revisionist was rejected under Sections 379/411, 413, 420, 467, 468, and 471 of IPC arising out of FIR No. 49 of 2013 State vs. Raju.
(2.) An FIR was lodged against three named accused persons including the present revisionist for the offences punishable under Sections under Sections 379/411, 413, 420, 467, 468, and 471 of IPC. The allegation against the accused persons, in a nutshell, was that 13 stolen motorcycles were recovered from the joint-possession of the accused persons including the revisionist. Learned counsel for the revisionist contended, among other things, that present accused was granted bail in Case Crime No. 25 of 2013 under Section 379/411 relating to PS Rudrapur vide order dated 05.03.2013 of learned Sessions Judge, Udham Singh Nagar. That order was in respect of recovery of one stolen motorcycle. Present first information report was in respect of the joint recovery of 13 motorcycles from the possession of the accused persons including the revisionist.
