(1.) Learned counsel for the revisionist confined his prayer only to the extent that the revisionist be directed to be sentenced for the period already undergone by him alongwith payment of fine. Revisionist was convicted for the offences punishable under Sections 409, 420, 467, 471 IPC. He was directed to undergo simple imprisonment for three years for each offence punishable under Sections 409, 467 and 471 IPC. He was also directed to undergo simple imprisonment for two years in connection with each offence punishable under Section 420 and 468 IPC. All the sentences were directed to run concurrently.
(2.) The accused was also directed to pay a fine of Rs. 20,000/- on first three counts each and a fine of Rs. 10,000/- on subsequent two counts each. He was directed to pay fine of Rs. 20,000/- each under Sections 409, 467 and 471 IPC, failing which he was to undergo further simple imprisonment for three months on each count. He was also directed to pay fine of Rs. 10,000/- each under Sections 420, 468 IPC, failing which he was to undergo further simple imprisonment for two months on each count.
(3.) It is the submission of learned counsel for the revisionist that revisionist remained in jail for one year eight months and is ready to deposit the amount of fine imposed upon him. Revisionist had already attained the age of superannuation and the FIR was lodged after three years of his retirement. He was a Head Clerk in the office of District Commandant Home Guards, Haridwar.
