RUP SINGH Vs. STATE OF UTTARAKHAND

JUDGEMENT

(1.) OUT of the five appellants, the appeal has been abated against three, namely, Rup Singh, Komal and Kadher as they have died.

(2.) NOW , only two appellants Ram Gopal and Sundar Lal remain, who have been heard through the learned Amicus Curiae. Learned State Counsel has also been heard.

(3.) THE FIR was lodged for the offence of Section 392 IPC against three intruders, namely, Om Singh, Mohan Singh and Malkhan Singh along with their parentage and address. In the said report, Smt. Bachhi Devi besides naming the above three disclosed the number of intruders as 3 to 4.
