(1.) THE applicants were convicted by learned Addl. Judicial Magistrate, Khatima, vide order dated 15.04.2010, for the offences punishable under Sections 498A, 323, 504, 506 of IPC and Section 4 of the Dowry Prohibition Act, and were sentenced accordingly. Feeling aggrieved against the same, the convicts preferred a criminal appeal, which is pending before Sessions Judge, Udham Singh Nagar. In the meantime, parties settled their dispute amicably with the intervention of few elderly persons of their community and, therefore, they moved compounding application in present application under Section 482 of Cr.P.C.
(2.) A compromise/compounding application, being CLMA no. 1163 of 2014, is filed by the parties to indicate that they have buried their differences and have resolved their dispute amicably. Applicant no. 1 has filed an affidavit. Respondent victim has also filed her affidavit with the compounding application. Terms of settlement have been mentioned in paragraphs no. 6 and 7 of the affidavit of applicant no. 1. The terms of settlement also find place in paragraphs no. 6 and 7 of the affidavit of the respondent victim.
(3.) SMT . Preeta Mandal (respondent herein) is present in person before the Court, duly identified by her counsel Mr. D.K. Tyagi, who stated that she is no more interested in prosecuting the applicants. Applicant no. 1 Vikas Mandal is also present in person before the Court, duly identified by his counsel Mr. M.K. Ray. He also affirmed the terms of settlement, as also the fact that he and respondent have sorted out their differences amicably.
