SUJEET KUMAR Vs. STATE OF UTTARAKHAND

JUDGEMENT

(1.) A complaint (Ext. Ka-1) was written by Ram Sanhai on 19.07.1995 addressed to the Station Officer, police station Jwalapur, District Haridwar, which was registered as case crime no. 245 of 1995 against Sujeet Kumar and Smt. Sushila in respect of offence punishable under Section 304B of IPC. After the investigation, chargesheet (Ext. Ka-11) was submitted against the accused persons in respect of selfsame offence. The case was committed to the Court of Sessions, for trial.

(2.) When the trial began and prosecution opened it's case, charge in respect of offence punishable under Section 304B of IPC was framed against the accused persons on 16.12.1997, to which they pleaded not guilty and claimed trial.

(3.) PW1 Ram Sanhai, PW2 Jageshwar, PW3 Dr. Hari Krishan Fularia, PW4 Raju, PW5 Ganga Prasad, PW6 Dr. A.K. Jain, PW7 Head Constable Bijendra Singh, PW8 Smt. Sukh Devi, PW9 S.I. Rajbeer Singh and PW10 I.O. Ishwar Chand Sharma were examined on behalf of the prosecution.
