(1.) Heard Mr. Vinay Kumar, the learned counsel for the petitioner, Mr. K.N. Joshi, the learned Deputy Advocate General for the State of Uttarakhand/respondent Nos. 1 & 2, Mr. Dinesh Gahtori, the learned proxy counsel for Mr. B.D. Kandpal, the learned counsel for respondent No. 3, and Mr. Vikas Pandey, the learned counsel for respondent No. 4.

In this writ petition, the petitioners have assailed the refusal to accept their applications by the Uttarakhand Public Service Commission, Haridwar for being selected on the posts of Assistant Professor (Political Science). Their applications have been rejected on the ground that they have scored less than 45% marks in the graduation level. However, Mr. Kumar would argue and submit that in the qualification criteria prescribed by the University Grants Commission as published on 18/7/2018 in the Gazette of India : Extraordinary, no such qualification or percentage of marks has been specified for the graduation level.

However, the learned counsel for the Uttarakhand Public Service Commission submits that at Page-107 (internal), the criteria for short-listing the candidates for interview for the posts of Assistant Professor in the Universities is provided. It provides that the last bracket to be 45% to 55%, for graduation. Therefore, it is argued that the petitioners are not qualified.
