JUDGEMENT

(1.) HEARD Sri Amish Tiwari, Advocate appearing on behalf of the petitioners as well as Sri N.P. Sah, Standing Counsel appearing for the State of Uttarakhand.

(2.) THE petitioners are C.P.Ed. trained teachers. Admittedly, C.P.Ed. is a certificate of training which was earlier given to those who were trained for physical training. This certificate has got nothing to do with actual classroom teaching in a primary school. In other words, the petitioners were "untrained" as a primary school teacher. THE petitioners, however, secured appointment as primary school teachers though the grade which was given to them was of untrained teachers. During the course of employment, in the year 2000 the petitioners have completed B.T.C. training and since the completion of their training they are getting the scale of trained teachers.

(3.) LEARNED counsel for the petitioners has now stated that during the pendency of this writ petition, the petitioners have now completed 10 years of service on the regular grade prescribed to the trained teachers for getting selection grade. This fact has not been denied by the State counsel. As such, though the writ petition for the aforesaid prayer made by the petitioners is dismissed, it is directed that the Secretary, Education, Dehradun either himself or through the Director of Education, Dehradun shall consider the claim of the petitioners for selection grade and pass appropriate orders therein within three weeks from the date a certified copy of this order is produced before him, considering 10 years of continuous service since the petitioners were placed on the "trained grade" of teachers.
